Welcome to AmpersandInk and Gathering Moments! These Terms & Conditions (“Terms”) govern your access to and use of the Gathering Moments digital subscription service, including all digital guides, downloads, resources, communication, and related content (collectively, the “Service”). By subscribing or accessing the Service, you agree to these Terms. Please read them carefully.
1. Subscription & Access
- The Service provides digital resources delivered on a recurring basis (monthly, seasonally, or annually depending on your selected plan).
- Your subscription grants you personal, non-exclusive, non-transferable access to the digital content provided.
- Login credentials may not be shared or distributed. One subscription = one household.
- AmpersandInk or Gathering Moments may update, modify, or replace content at any time.
2. Payment & Renewal
- Payment is required at the time of purchase and will renew automatically according to your subscription plan (monthly or annual) unless canceled prior to the renewal date.
- By subscribing, you authorize AmpersandInk and Gathering Moments (or our payment processor) to charge the payment method on file for all recurring fees.
- Prices may change in the future, but existing subscribers will be notified in advance of any rate changes.
3. Cancellations & Refunds
- You may cancel your subscription at any time through your account settings or by contacting us directly.
- Cancellations take effect at the end of the current billing period.
- Because digital content is delivered immediately, all payments are non-refundable, including partial-period refunds or credits.
4. Digital Content License
- All content, downloads, guides, images, templates, and materials provided through the Service are owned by Gathering Moments and protected by copyright.
- Subscribers receive a personal-use license only.
- You may not reproduce, distribute, resell, share, upload, or otherwise make the content available to others outside your household.
- You may print digital resources for your personal family use.
5. Prohibited Uses
You agree not to:
- Use the Service for commercial purposes without written permission.
- Copy, modify, distribute, or recreate digital materials for external or public use.
- Upload or transmit harmful code, attempt unauthorized access, or misuse the website or content.
6. Communication
By subscribing, you agree to receive service-related emails including content delivery notifications, updates, billing notices, and optional promotional messages. You may opt out of promotional emails at any time, though you will continue receiving essential service messages.
7. Availability & Service Changes
- We strive to maintain uninterrupted access to the Service, but occasional downtime may occur due to maintenance, updates, or technical issues.
- We may modify or discontinue parts of the Service at any time. If a substantial change impacts your subscription, we will notify you.
8. Disclaimer of Warranties
The Service and all content are provided “as is” and “as available.”
Gathering Moments makes no warranties regarding:
- The accuracy or completeness of content,
- Uninterrupted access,
- Fitness for a particular purpose.
Use of the Service is at your own discretion.
9. Limitation of Liability
To the fullest extent permitted by law:
- Gathering Moments is not liable for any indirect, incidental, or consequential damages arising from your use of the Service.
- Our total liability for any claim will not exceed the amount paid for your subscription during the 12 months preceding the claim.
